Terms & Conditions of Service

1. Acceptance of Terms

By accessing or using the MobiVTT website and services (collectively, the “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Service. These Terms apply to all visitors and users of MobiVTT worldwide. By using the Service, you represent that you are at least 13 years of age (or the age of legal consent in your jurisdiction) or are using the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Service Description

MobiVTT provides a hosted digital character-sheet interface for tabletop role-playing games (primarily Dungeons & Dragons 5th Edition) integrated with the FoundryVTT platform. Our Service enables you to view and interact with your character sheet on web and mobile devices in real-time. We offer a free version of the Service (with basic functionality) and a premium subscription that unlocks additional features. No user accounts are required to use MobiVTT; even for premium features, we do not create a user profile for you. Instead, paid subscribers are granted access via a unique access code (see Section 3). All use of the Service, whether free or paid, is subject to these Terms.

3. Subscriptions, Payments & Access Codes

Paid Subscription: MobiVTT’s premium features are accessible through a subscription plan. All subscription payments are processed securely by our third-party payment provider, Stripe. When you subscribe, you will be directed to a Stripe checkout page to enter your payment information. We do not collect or store your credit card details on our own servers.
Access Code Delivery: Upon successful payment, you will be provided with a unique alphanumeric access code. This code will be shown on the confirmation page and may also be sent to the email address you provided during checkout. The access code serves as your key to unlock premium features on MobiVTT.
Access Code Usage: Your access code is personal and non-transferable. You may use it to enable premium access on your devices (for example, to view your character sheet with premium features on up to three (3) of your devices simultaneously, such as your phone, tablet, and laptop). Using the code on a new device may require you to log out from one of the previous devices if the limit is exceeded. Sharing your access code with others or posting it publicly is a violation of these Terms and may result in suspension of service (see Section 5: Acceptable Use).
Auto-Renewal & Cancellation: Subscription plans renew automatically at the end of each billing cycle (e.g. monthly or annually, as applicable) unless you cancel before the next renewal date. You can manage or cancel your subscription at any time via the Stripe Customer Portal link provided after checkout or in your subscription confirmation email. If you cancel, you will continue to have access to premium features until the end of your current paid term, after which the access code will no longer unlock premium features.
Free Plan: If you are using MobiVTT’s free plan, no payment is required and you will not receive an access code. Free plan users can still use the Service with basic features but do not get premium functionality. We reserve the right to change the features of the free plan or introduce new limitations as needed.
No Refunds: All subscription charges are final and non-refundable, except where required by law or explicitly stated otherwise. This means that if you cancel in the middle of a billing period, you will not receive a refund for the remaining period of your subscription; you will retain access until the period ends. We may consider exceptions in extenuating circumstances (such as a technical issue on our side that severely affected your use of the Service), but those are granted at our sole discretion.

4. License Grant

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the MobiVTT Service for your personal, non-commercial use, specifically for the purpose of managing and viewing your own (or your authorized players’) tabletop RPG character sheets. This license is provided solely for personal tabletop gaming and does not grant you any rights to our software or content beyond what is necessary for that use. You agree not to use the Service for any commercial venture (for example, you may not resell our Service or integrate it into a product you offer for sale). All rights not expressly granted to you are reserved by MobiVTT and its licensors.

5. Acceptable Use

When using MobiVTT, you agree to abide by the following rules and restrictions. You must not:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Use the Service in a manner that infringes or violates the intellectual property rights or privacy rights of others. ( For example, do not use MobiVTT to display or distribute content that you do not have rights to, or to harvest personal data about others without consent.)
Attempt to reverse-engineer, decompile, hack, or disrupt the Service. This includes not attempting to bypass any security measures, not trying to access other users’ data, and not introducing any viruses, worms, or malicious code into our application.
Share, sell, or publicly post your access code or any other authentication token provided to you. Your access code is meant for your use only (as per Section 3). Sharing it with others is strictly prohibited.
Engage in any activity that overburdens or degrades the performance of the Service for other users. This includes any form of automated usage that is abusive (such as bots scraping the site in a way that interferes with our servers) or any attempts to flood or spam the Service.

Violating any of the above rules constitutes a breach of these Terms and may result in immediate suspension or termination of your access to the Service (see Section 7). We reserve the right to investigate any behavior that we suspect violates the spirit or letter of the Acceptable Use provisions and to take appropriate action.

6. Intellectual Property

All content, software, code, and materials comprising the MobiVTT Service (including but not limited to the website design, text, graphics, logos, and software logic) are the property of MobiVTT or our licensors and are protected by intellectual property laws. All trademarks and logos displayed on the Service (including the name “MobiVTT” and our logo) are owned by MobiVTT. Using our Service does not grant you any ownership of or rights to any aspect of our intellectual property, except for the limited usage rights granted under these Terms. You may not reproduce, distribute, create derivative works from, publicly display, or reverse-engineer any portion of the Service unless expressly permitted by us in writing. If you provide feedback or suggestions to MobiVTT regarding the Service, we may use such feedback without obligation to you, and you hereby grant MobiVTT a worldwide, irrevocable, royalty-free license to use and incorporate your feedback in our products or services.

7. Termination & Suspension

We reserve the right to suspend or terminate your access to the Service (including invalidating your access code) at any time, with or without notice, if we have reason to believe that: (a) you have violated these Terms (or any portion of them), or (b) your use of the Service creates risk for us or for other users, or could create legal liability for MobiVTT. We also reserve the right to discontinue the Service (or any part of it) at our discretion, though we will strive to notify users in advance if possible. If your access is terminated due to a breach of these Terms, you will not be entitled to any refunds for any remaining subscription period, and we may bar you from re-registering or using the Service in the future. Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop using the Service. Sections of these Terms that by their nature should survive termination (such as limitations of liability, disclaimers, and intellectual property provisions) will continue to apply even after termination.

8. Disclaimer of Warranties

MobiVTT is provided “as is” and “as available”. You use the Service at your own risk. To the fullest extent permitted by applicable law, we disclaim all warranties and representations, whether express, implied, or statutory, including but not limited to any implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, or accuracy. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. Specifically, while we aim to provide a reliable and high-quality service, we do not warrant that (a) the Service will meet your specific requirements or expectations, (b) the Service will be available at any given time or location, or operate in an uninterrupted or error-free manner, (c) any defects or errors in the Service will be corrected, or (d) the Service is free of viruses or other harmful components. Any content or data obtained through the Service is obtained at your own discretion and risk, and you are solely responsible for any damage to your device or loss of data that results from use of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, MobiVTT (and its creators, developers, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, business interruption, or other intangible losses, even if we have been advised of the possibility of such damages. In no event will MobiVTT’s total cumulative liability to you for all claims arising from or related to the Service ( including any software or content on the Service) exceed the amount you have paid to us for the Service in the twelve months immediately preceding the event giving rise to the claim. If you have not paid anything (for example, if you are using the free plan), MobiVTT’s liability to you shall be zero or the minimum amount permitted by law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for incidental or consequential damages. To the extent that such laws apply to you, some of the exclusions or limitations above may not apply to you, and you may have additional rights. In such cases, MobiVTT’s liability will be limited to the fullest extent permitted by applicable law.

10. Changes to Terms

MobiVTT may modify or update these Terms & Conditions from time to time. When we do, we will update the “Last Updated” date at the top of this document. If changes are significant, we will make an effort to inform active subscribers or post a prominent notice on our website. However, it is ultimately your responsibility to review the Terms periodically for any changes. Continued use of the Service after an update constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you must stop using the Service. No amendment to these Terms will apply to any dispute that we had actual notice of before the effective date of the amendment.

11. Governing Law & Jurisdiction

These Terms & Conditions and any dispute arising out of or in connection with the Service shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. You agree that any such disputes will be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia. If you are accessing the Service from a jurisdiction where the laws conflict with or do not permit the enforcement of any part of these Terms, you agree that you will only use the Service in a manner lawful in your jurisdiction. Regardless, you agree that any disputes shall be resolved in accordance with the laws of Estonia as stated above.
